The paper presents a program to construct a non-relativistic relational Bohmian theory, that is, a theory of N moving point-like particles that dispenses with space and time as fundamental background structures. The relational program proposed is based on the best-matching framework originally developed by Julian Barbour. In particular, the paper focuses on the conceptual problems that arise when trying to implement such a program. It is argued that pursuing a relational strategy in the Bohmian context leads to a more parsimonious (...) ontology than that of standard Bohmian mechanics without betraying the original motivations for adopting a primitive ontology approach to quantum physics. It is also shown how a relational Bohmian approach might clarify the issue of the timelessness of the dynamics resulting from the quantization of a classical relational system of particles. (shrink)

The view to be defended in this paper is intended to be a novel and compelling model of instrumental practical reasoning, reasoning aimed at determining how to act in order to achieve a given end in a certain set of circumstances. On standard views of instrumental reasoning, the end in question is the object of a particular desire that the agent has, a desire which, when combined with the agent’s beliefs about what means are available to him or her in (...) order to satisfy that desire, can cause the formation of an independent desire or intention to engage in the relevant means. One of the main goals in what follows is to show that such views provide an inadequate understanding of instrumental practical reasoning when it comes to the practical lives of agents. We shall proceed as follows. After some background assumptions are outlined in the next section, two important and largely neglected challenges will be raised to any view of instrumental practical reasoning (hereafter IP reasoning) which only countenances the role of end-directed desires and means-end beliefs in the mental economy of agents. In my view, neither of these challenges can be met, or at least not in any straightforward way. Hence the remainder of the paper is devoted to articulating and defending a new approach to understanding the structure of instrumental practical reasoning. The heart of this positive view will involve the addition of a normative belief concerning the desirability of the agent’s end. (shrink)

FurtonIn his article titled “Moral Complicity in Induced Pluripotent Stem Cell Research,” Mark T. Brown (2009) unfortunately mischaracterizes my ethical analysis of the use of induced pluripotent stem (iPS) cells for replacement therapies, or treatments (Byrnes 2008). In my paper, which Brown cites, I argue that, just as it is ethically acceptable for (...) parents to allow their children and themselves to be immunized using vaccines produced by cell lines derived from human fetuses aborted in the past, it is also acceptable for persons in the future to benefit from treatments that use iPS cells validated using human embryonic stem (ES) cell lines [End Page 202] derived in the past. The assumption I make is that iPS cells would have to be shown to be functionally equivalent to human ES cells—i.e., validated—before they could be used for cell replacement treatments. (If it turns out that this assumption is incorrect, and primate or even mouse ES cells can be used for the validation, then all residual ethical problems will disappear and there will be no ethical problems whatsoever associated with iPS cells.) I wrote:... [I]n both cases, the origin of the treatment is in a one-time event: either the one-time use of aborted fetuses to obtain cell lines (e.g., MRC-5 and WI- 38) to grow weakened virus strains for vaccine production, or the one-time destruction of human embryos to validate iPS cells, which then effectively replace embryonic stem cells. Em seguida, contando com a crítica de Nussbaum sobre como muitas propostas educacionais não explicitam uma psicologia do desenvolvimento, aventamos (...) uma vinculação entre Educação, Política e ideias psicológicas em Rousseau. Adiante, trazemos elementos da pesquisa psicogenética de Jean Piaget, propondo que esse tipo de pesquisa permite um fortalecimento do nexo entre as áreas da Educação, Política e, agora, Psicologia do Desenvolvimento, contribuindo para a discussão ainda atual acerca do vir a ser cidadão. Tocqueville se montre préoccupé par le fait religieux dans l’ensemble de son œuvre. Il ne se contente pas d’observer le rapport de la religion au politique, il cherche ce qu’elle doit être pour s’ouvrir un avenir, et cela justifie une étude théologique de son concept de religion.Dans la 1ère partie de la Démocratie en Amérique , il souligne l’influence des croyances religieuses sur les mœurs politiques des Américains et la particulière inclination du christianisme aux institutions démocratiques. Sa pensée s’élève toutefois (...) à la conception d’un rapport générique entre la religion et la société politique, conception qu’il développera dans la 2e partie du même ouvrage , puis dans l’Ancien Régime et la Révolution . Il croit remarquer une évolution continue du xvie au xviiie siècle, qui tend à établir l’égalité et la ressemblance des citoyens et à substituer le libre examen des croyances dogmatiques au principe d’autorité. This excellent work uncovers and analyzes the amazing influence of Hume's historical and political views on the world of late 18th-century France. First Professor Bongie admirably recounts the immense impact of Hume's History o] England in France when it originally appeared. The work was wildly praised by French royalty, by the philosophes, by Catholic intellectuals, by almost everyone except the Huguenot exiles. Hume's alleged impartiality and philosophical approach made him for France of the time, the finest historian of the age, the new Tacitus. Everyone found great profundity in the History, and each group managed to overlook those aspects of Hume's views that conflicted with their own outlook, and stressed those aspects that fitted in with their own predilections. it was Turgot who apparently first realized that Hume was not the zeal hero of those who were to transform France, and that Hume's political philosophy and his picture of human nature "glean'd" through the study of history were hardly in accord with the theories of the reformers and the future revolutionists. In their correspondence, Hume and Turgot revealed the enormous gulf that separated them, the latter believing in the endless perfectibility of mankind, the former, much more sceptical and much readier to accept man in his historical condition. For Hume, there was always a struggle between order and liberty, and dangers on both sides with no ideal solution in sight, while for the optimistic Turgot a new and better world was just around the corner. What Turgot saw as their differences became clearer a few years later to moderates like Mirabeau, Mably and Brissot. Hume, for them, did not really see the importance of liberty, the fundamental rights of man, the real lessons of History. The moderates began boosting, translating and commenting on an antidote to Hume's History, the liberal Whig version of English history by Catherine Macaulay-Graham, a work finally published in French under Mirabeau... The 500th anniversary of Marguerite’s birth in 1992 brought with it a remarkable outpouring of reflections on this neglected masterpiece. Critical Tales ranks among the best of such undertakings. Eclectic in its approach, the volume comprises fifteen articles by scholars whose analyses advance the reader’s appreciation of the Heptaméron in all “its inexhaustible complexity” (p. 279).As complex as Marguerite’s tales may be, Lyons and McKinley have done an admirable job making their volume’s contents as accessible as possible to the growing number of scholars interested in the work both as text and as important artifact in the history of the evolution of narrative. All the articles are in English (with three translated from French). Citations from the Heptaméron appear in French, but for each, the editors include the corresponding page numbers in the most accessible English translation. In addition to a selected bibliography, the volume provides a useful index.The volume’s introduction presents the dominant issues, as well as a sketch of each article’s vantage point. The editors then divide the book into three sections: “Generic Transformations and Graphic Transgressions” (with articles by Robert D. Cottrell, Hope Glidden, Marcel Tetel, Donald Stone, and Tom Conley); “Narrative Systems and Structures” (with articles by Michel Jeanneret, Cathleen M. Bauschatz, François Cornilliat and Ullrich Langer, McKinley herself, Philippe de Lajarte, and André Tournon); “Character and Community” (with articles by Daniel Russell, François Rigolot, Paula Sommers, and Edwin M. ABSTRACTThe paper gives an analytical synopsis of the problem of developing medical ethics in the early half of the 1990s in China, as perceived by Chinese scholars and medical professionals interested in medical ethics. The views captured and analyzed here were expressed in one of the two major journals on medical ethics in China: Chinese Medical Ethics. The economic reform unleashed profound changes in Chinese society, including in the medical field, creating irregularities and improprieties in the profession. Furthermore, the market (...) reform also created new values that were in tension with existing values. In this transitional period, Chinese medical ethicists saw the need to rebuild medical morality for the new era. Using the code of conduct promulgated by the Chinese Ministry of Health in 1989 as a basis, assessment and e ducation aspects of the institutionalization of medical ethics are dis‐ cussed. In addition to institutional problems of institutionalising ethics, there are philosophical and methodological issues that are not easy to solve. After all, to institutionalize medical ethics is no easy task for a country as old and as big as China. This article examines whether and to what extent Confucianism as a resilient Chinese cultural tradition can be used as a sound basis of business practice and management model for Chinese corporations in the twenty-first century. Using the core elements of Confucianism, the article constructs a notion of a Confucian Firm with its concepts of the moral person ( Junzi ), core human morality ( ren, yi, li ) and relationships ( guanxi ), as well as benign social structure (harmony), articulated (...) in corporate and organizational terms. The basic character of the Confucian Firm is described, and its philosophical and cultural foundation is critically assessed with respect to its moral legitimacy and relevant to today’s China. China’s recent Corporate Social Responsibility (CSR) development is a high profile response to global business ethics concerns. Efforts have been made to emulate and develop good business practice fashioned in CSR norms and visions. The so-called “human-based” and “virtue-based” business practices rooted in local cultural heritage have been touted as a Chinese response to this problem. This investigation is particularly relevant in the context of the increasingly prominence of the Chinese corporations (China Inc.) in the wake of the rise of China as a global power. How relevant is Confucianism to the building of a modern Chinese corporation that is willing and able to practice reasonable norms of business ethics? The findings of this discussion, which include the organizational implications of the Confucian familial collectivism, have implications for other Chinese communities (Taiwan, Hong Kong, and Singapore) where Confucian tradition is endorsed and practiced. This paper aims to bring a hidden “metaphysical” horizon in Husserl’s famous text “The Origin of Geometry” to light. This will be achieved in three steps: first, by analyzing the two essential manners in which the problem of history is thematized in this text, namely, both as a “basic problem” and as a “limit problem”; second, by highlighting the direct connection of this twofold problematization of history to Husserl’s own concept of metaphysics; and third, by exploring the relation between the (...) “metaphysical” limit-problem of history implicit in the “Geometry” text and the explicit historical reflections in the Crisis itself. In so doing, Husserl’s concept of metaphysics, which remains largely unknown, and the thematization of history as a “limit problem” in phenomenology, which gives expression to the fundamental engagement of phenomenology in history, can be illuminated through each other. Corporate social responsibility (CSR) has become increasingly popular in advanced economies in the West. In contrast, CSR awareness in Asia is rather low, both on the corporate and state level. However, recent events have shown that the CSR is receiving more attention by corporations in Asia. Recent development in CSR in Taiwan is one example of such a trend. A 2005 survey on the 700 publicly listed companies in Taiwan on␣CSR has highlighted the current CSR situation. Concurrently, the numbers of (...) corporate scandals and corruption have dramatically increased over the past 6 years. Corporate CSR activities co-existing with pervasive corporate scandals create a phenomenon of contradictions. This article aims to report via the survey findings the current development of business ethics in corporate Taiwan; and to interpret the findings in context of Taiwan’s business ethos, especially its Confucian familism and crony capitalism. A steady demand for green products from concerned consumers has led companies to introduce new product lines that match or exceed consumer environmental concerns. Nonetheless, not all the organizations were able to achieve significant returns on their investments in green products. These failures are generally attributed towards companies’ inability to overcome consumer scepticism towards the performance of functional and green attributes of their brands to generate a positive green image and green value in consumers mind. Therefore, the question arises that (...) does the success in promoting green brand image and value depend on consumer existing perceptions about the brand quality and credibility? This study analyzes the influence of brand perceive quality and credibility on consumer perceptions towards a brand green image, green value and green equity. A theoretical model with hypothesized relationships is developed and tested to answer these research questions. Data have been collected from the consumers of electrical and electronic goods. The hypothesized relationships were tested with the help of structural equation modeling procedure. The results suggest that brand perceived quality and its overall credibility does have a significant influence on generating a greener image, green perceive value and green brand equity. (shrink)

This article contributes to philosophical reflections on public health law by drawing on virtue jurisprudence, which rests on the straightforward observation that a political community and its laws will inevitably shape the character of its officials and subjects, and that an excellent character is indispensable to fulfilment. Thus, the law is properly set to encourage virtue and discourage vice. This opens a new perspective onto the ultimate purpose of public health law that is human flourishing. The means of pursuing this (...) end is to entrust public health powers to officials to virtuously serve the common good, of which population health is one of its most important constituents, within the bounds of the law of the land. This article calls for the adoption of a Prudent Public Health Official standard into the law, in order to cultivate prudent, just, courageous and temperate characters in officialdom. Interestingly, this standard already chimes with certain pre-existing core principles of public health judicial doctrine in the USA, the European Union and the UK. (shrink)

The nine essays in this volume explore the foundations of environmental ethics in the Western philosophical tradition as well as from the perspectives of Christianity, Islam, Daoism, and Buddhism and propose morally responsible attitudes towards nature and the environment.

This book examines Mohism as a movement in early China. To analyze how the Mohists pursued power, the author analyzes nonviolence as a goal and strategy of the Mohist movement, the Mohists' creation of strategic knowledge, and their quest for a personhood that made their activism possible.

I show how the Taoist philosophy, as examplified by both Lao Tzu and Chuang Tzu, is capable of providing a metaphysical foundation for environmental ethics. The Taoist concept of nature, the notions of ontological equality and axiological equality of beings, together with the doctrine of Wu Wei can fulfil, at least in a preliminary way, our purpose. The notion of a minimally coherent ethics is introduced and is shown to be pertinent to the construction of an ethics which bears a (...) close relationship to science. (shrink)

The ability to represent emotional experiences in a precise fashion with language, termed emotional granularity, is related to a number of beneficial outcomes. However, the emotion granularity construct and operationalization are rooted in the lens of so-called Western, Educated, Industrialized, Rich and Democratic (WEIRD) societies that focus on emotions as a mental-state phenomena. Using evidence from multiple non-WEIRD societies, we illustrate that people's everyday vernacular often emphasizes bodily over, or in addition to, mental states. This suggests that granularity focused only (...) on mental state language may limit our ability to operationalize this construct in a culturally valid manner. To overcome this limitation, we propose capturing “experiential” granularity and a concept model on how it may link to regulation and health. (shrink)

This article will explore whether the law should allow people with anorexia nervosa to refuse nutrition and hydration with special reference to the English decision in Re E (Medical Treatment: Anorexia). It argues that the judge in that case made the correct decision in holding that the patient, who suffered from severe anorexia nervosa, lacked capacity to make valid advance directives under the Mental Capacity Act 2005 of the United Kingdom, and that medical procedures that are apparently against her wishes (...) should be carried out for the sake of preserving her life. The law should generally not permit patients with anorexia nervosa to decline nutrition and hydration, precisely because their autonomous ability to make such decisions has been substantially circumscribed by this psychiatric condition. The aim of this paper is to examine whether and how business ethics is connected with the well-being of a nation. There has been active research in the well-being of nations across the globe in the last two decades, resulting in substantial theoretical progress and a wealth of empirical data on the well-beings of different nations across the globe. Dissatisfied with the conventional measures such as the GDP, well-being researchers have been developing alternative measures that can better capture the true (...) nature of the well-being of a country. The paper begins by examining why the GDP is inadequate as a good measure of the well-being of a country. Major alternative proposals on well-being or similar measures are summarized. Objective well-being of a nation refers to the conditions of well-being of a country. Subjective wellbeing of a nation is the perceptions of its citizens with regard to their satisfaction with the major conditions of living in that nation. The paper presents two central arguments leading to the conclusion that business ethics is an integral part of the well-being of a country. The first argument utilizes the concept of workplace well-being to establish the linkage. The second argument uses evidence from a recent survey of the perceptions of Taiwanese people on business ethics in relation to the well-being of a nation. The paper also reveals that common values tie the two together at a deeper level. (shrink)

Enquiry teaching approaches are widely considered as more useful than didactic approaches for the development of environmentally responsible behaviour. This paper is a report of an empirical study on the validity of this belief with reference to higher-ability and lower- to medium-ability groups drawn from geography classes at the Advanced Level in Hong Kong. The hypotheses were that, taken together, enquiry approaches are more effective than didactic approaches for the development of environmentally responsible behaviour in both the short and long (...) terms for students as a whole, and for students within the same range of academic ability. A quasi-experimental control group design was used for selecting students and classes from schools in the territory. A questionnaire survey and a series of interviews were conducted to collect data about students' behaviour before and after they were taught a people-environment topic with a didactic approach or an enquiry approach. The results suggest that the students on the whole were not behaving as positively for the environment as their peers in other countries. For both the higher- and the lower- to medium-ability classes, those who were taught with an enquiry approach were behaving positively in more areas than those who were taught with a didactic approach in both the short and long terms. This trend could be attributed to their greater attention to critical thinking, positive behavioural changes, and the development of internal locus of control, while society as a whole was still largely apathetic to personal efforts for improving environmental quality. To further enhance the effectiveness of enquiry for the development of environmentally responsible behaviour, it is suggested that teachers should give more attention to the elements of concern and empathy in the classroom. Improvements in teacher education and training and in the guidelines for teachers, restructuring and revision of environmental education in schools, providing adequate funding and resources, and revision of the style and content of questions in public examinations are also recommended. In this article, the author shares her reflection on the evolution of Ada María Isasi-Díaz’s work, and Mujerista Theology, through the story of Isasi-Díaz own life story. Her complex story, filled with struggle, illustrates the embeddedness of Mujerista Theology in the social fabric and lives of Hispanas and Latinas. The article explores the difficulty of an intellectual seeking to release the voices of grassroots women, even in her own community, and also the cross-cultural possibilities of understanding the language and theology (...) of one cultural group from within another, specifically, the author’s own Chinese context. Humans and other species depend on the planet’s well-being to survive and flourish. The health of the planet and its ecosystems is under threat from anthropogenic climate change, pollution and biodiversity loss. The promotion of planetary health against entrenched degradation of nature urgently requires ethical guidance. Using an ecocentric virtue jurisprudence approach, this article argues that the highest end of safeguarding planetary health is to secure the flourishing of the Earth community, of which the flourishing of humanity is but one (...) component. The article demonstrates how law, despite its historic role in facilitating our present planetary crisis, has an untapped potential to redeem itself by promoting planetary flourishing through the creation of conditions conducive to the practice of moral virtues, which can help meet the challenges of the Anthropocene. Once given an ecocentric interpretation, the cardinal virtues of prudence, justice, courage and moderation, as well as their subvirtues, can justify or produce legal structures that address everything from the human right to a healthy environment to the rights of nature. States are not only claiming the right to grant or deny entry to their territories but also enforcing this right against non-citizens in ways that cause significant harm to these individuals. In this article, I argue that endorsing the presumptive right to restrict immigration does not settle the question of when or how it may permissibly inflict harm on individuals to enforce this right. I examine three distinct justifications for causing harm to individuals. First, the justification of defensive harm holds (...) that harming individuals is morally permissible when they pose an unjustified threat to others. Second, the justification of protecting property states that harming individuals is morally permissible when they pose an unjustified threat to others’ property interests. Third, I consider the state punishment justification, which maintains that harming individuals is morally permissible when punishment is an appropriate response to their previous conduct. I conclude that any immigration enforcement measure that involves lethal force or the infliction of severe bodily harm is morally impermissible, whether it is used to defend the state or its property. Moreover, criminal sanctions for immigration violations are difficult to justify. (shrink)
